Framework Contract for Data Processing within Services

A Comprehensive Legal Framework for the Helmholtz Cloud

The Helmholtz Cloud has reached a significant milestone with the finalization of its third Helmholtz-wide framework contract. This achievement brings together three essential legal documents that establish a robust and transparent foundation for cloud-based research collaboration across all Helmholtz Centers.

The legal architecture consists of three interconnected agreements. The recently concluded Data Processing Framework Contract for Service Usage governs the relationship between the providing (as data processor) and the using center (as data controller) in accordance with the General Data Protection Regulation (GDPR): The framework contracts contains all general provisions that apply in every case to commissioned data processing for Helmholtz Cloud services, as well as the process for concluding the supplementary individual agreements for the services. This will enable the individual agreements (the actual AVVs) to be concluded via an electronic contract system in the future. A prototype of this system is currently under development.

This enables all parties involved to easily conclude AVVs for services and to fulfill their rights and obligations regarding the processing of personal data within the framework of Helmholtz Cloud Services.

Since 2024, the Joint Controler Agreement for Core Components has established the frame for data processing within the Helmholtz Cloud’s core infrastructure. Both GDPR agreements are based on the Helmholtz Cloud Ruleset, which define the purpose of use, duties and responsibilities for the provision and use of resources.

From the user’s perspective, this comprehensive legal framework delivers substantial benefits. Researchers and administrators can now rely on clearly defined responsibilities and transparent data processing procedures. The framework ensures GDPR compliance while maintaining the flexibility needed for collaborative research across institutional boundaries. Clearly defined processes, documented in the Process Framework for Helmholtz Cloud Service Portfolio and referenced in the agreement’s appendices, ensure reliable and high-quality service provision.
